These terms apply to prepaid services purchased from Shameless Promotion unless superseded by a signed service agreement.
By completing payment for a prepaid service, the Client acknowledges and agrees to the terms below.
1. Prepaid Services
Shameless Promotion offers certain services as prepaid programs, including audits, investigations, pilot marketing programs, and other fixed-scope services.
These services involve professional time, research, analysis, and strategic work that begins shortly after purchase. Because resources are allocated immediately, payments for prepaid services are non-refundable once work has begun.
2. Scope of Services
Services will be performed according to the program description, proposal, or documentation provided prior to payment.
The Client acknowledges that the program description defines the full scope of services included in the engagement. Services not specifically described in the program documentation are considered outside the scope and may require additional approval and fees.
Prepaid services do not include ongoing marketing management, consulting, or additional implementation beyond the stated scope unless agreed in writing.
3. Payment Terms
Prepaid services require payment in full prior to the start of work unless otherwise specified.
Once work has begun, payments are non-refundable.
All fees are stated before applicable taxes unless otherwise noted.
3A. Prepaid Support Hour Blocks
Certain prepaid services may be purchased as blocks of professional service hours that can be used for support requests, updates, consulting, troubleshooting, or small project work.
Hours purchased through prepaid blocks are applied to work performed by Shameless Promotion and are deducted as time is used.
The following terms apply to prepaid hour blocks:
- Work time is tracked in 15-minute increments
- Hours are deducted based on the actual time required to complete requests
Time may include activities reasonably required to complete the request, including but not limited to:
- reviewing and planning tasks
- performing updates or technical work
- research and troubleshooting
- internal coordination and task management
- strategy discussions or meetings with the Client
- reviewing results or testing completed work
Prepaid hours allow work to be completed without preparing individual quotes or approvals for each request, which may improve efficiency and reduce administrative time associated with smaller tasks.
Prepaid hour blocks are non-refundable once work has begun.
Unless otherwise specified in writing, prepaid hours are valid for 12 months from the date of purchase. Unused hours may expire after this period.
Prepaid hours do not guarantee immediate scheduling or priority service. Work will be scheduled based on current project timelines and team availability.
Requests that fall outside the scope of Shameless Promotion’s normal services, require external expenses, or involve larger project work may require a separate proposal or agreement.
3B. Emergency Support Hour Blocks
In situations requiring expedited service, Shameless Promotion may offer emergency support hour blocks.
Emergency support hours are billed at one and a half (1.5x) the Client’s standard hourly rate and are not eligible for prepaid block discounts or reduced rates.
Emergency hours must be purchased in one-hour increments and are intended for urgent or time-sensitive requests requiring prioritization outside of normal scheduling.
All other terms applicable to prepaid hour blocks apply to emergency support hours unless otherwise specified.
4. Timeline
Any timeframes or estimated delivery dates provided by Shameless Promotion are estimates only and are not guaranteed. Timelines may vary depending on factors such as:
availability of account access
responsiveness to requests for information
availability of client materials
Delays caused by missing access or materials may extend the project timeline.
5. Client Responsibilities
The Client agrees to provide timely access to accounts, credentials, information, and materials required to perform the services.
Failure to provide necessary access or information may delay the project and may limit the effectiveness of the services provided.
6. Audits, Evaluations, and Investigations
Certain prepaid services, including SEO audits, visibility snapshots, and access investigations, are diagnostic or advisory services.
These services identify issues, analyze performance, and provide recommendations based on available data at the time of review.
Unless explicitly stated in the program description, these services do not include implementation of recommendations or ongoing optimization services.
6A. Design, Branding, and Content Creation Services
Certain prepaid services may include branding design, profile setup, graphic creation, or social media content development.
Deliverables are provided according to the scope described in the program documentation. Minor revisions may be included where specified in the program description. Additional revisions or changes beyond the included scope may incur additional fees.
Once final deliverables are approved, delivered, or scheduled, additional changes may require a new scope of work or hourly services.
7. No Guarantee of Results
Shameless Promotion does not guarantee specific rankings, traffic levels, leads, or business outcomes.
Marketing performance and search visibility are influenced by factors outside Shameless Promotion’s control, including search engine algorithms, competitor activity, platform changes, market conditions, and website history.
Shameless Promotion will apply professional expertise and industry best practices in performing services.
8. Third-Party Platforms
Services may involve third-party platforms including search engines, directory services, analytics tools, hosting providers, or advertising platforms.
Shameless Promotion is not responsible for outages, policy changes, data discrepancies, or performance changes caused by these platforms.
9. Changes in Scope
Requests for services outside the agreed scope may require additional time and fees. Shameless Promotion will notify the Client before performing out-of-scope work.
10. Intellectual Property
Upon full payment, the Client receives ownership of final deliverables created specifically for the prepaid service.
Shameless Promotion retains ownership of internal tools, templates, systems, methodologies, and proprietary processes used to perform the work.
11. Limitation of Liability
Shameless Promotion’s total liability for any claim related to services provided shall not exceed the total amount paid by the Client for the prepaid service.
Shameless Promotion is not liable for indirect, incidental, or consequential damages including loss of revenue, profits, or business opportunities.
12. Dispute Resolution
Any disputes exceeding the jurisdiction of small claims court will be resolved through binding arbitration in Pierce County, Washington, under the laws of the State of Washington.
Each party will bear its own legal costs unless otherwise awarded by the arbitrator.
13. Force Majeure
Shameless Promotion will not be liable for delays or failure to perform services due to circumstances beyond reasonable control, including natural disasters, cyber incidents, or third-party platform disruptions.
