These terms apply to the Website Software Updates Add-On purchased from Shameless Promotion, LLC.
These Website Software Updates Add-On Terms supplement Shameless Promotion’s Prepaid Services Terms. By purchasing this service, the Client agrees to both these Website Software Updates Add-On Terms and the Prepaid Services Terms. In the event of a conflict, these Website Software Updates Add-On Terms shall control with respect to the Website Software Updates Add-On.
By purchasing this service, the Client acknowledges and agrees to the following:
1. Service Description
The Website Software Updates Add-On is available exclusively to Shameless Promotion hosting clients.
This service includes routine WordPress software updates performed on a scheduled maintenance basis, including:
- WordPress core updates
- WordPress plugin updates
- WordPress theme updates
- Basic post-update verification
2. Service Limitations
This service is intended to provide routine software maintenance and does not include:
- Website redesigns
- Custom development
- New functionality
- Theme customization
- Malware removal
- Website restoration
- Extensive compatibility testing
- Third-party software support
- Server administration
- PHP version upgrades
- Emergency support
3. Update-Related Issues
While most updates are completed without issue, software updates may occasionally result in compatibility conflicts, display issues, functionality problems, or other unexpected behavior due to outdated software, customizations, third-party tools, hosting environments, or factors outside of Shameless Promotion’s control.
Troubleshooting, repair, recovery, restoration, custom development, or other work required to resolve update-related issues is not included in this service and will be billed separately at Shameless Promotion’s current hourly rates.
4. Third-Party Software
Shameless Promotion may install updates for third-party plugins and themes as part of this service but does not guarantee the ongoing functionality, compatibility, security, or support of third-party software.
5. Scheduling
Updates are performed on a routine maintenance schedule determined by Shameless Promotion. Updates are not guaranteed to occur immediately after a software release becomes available.
6. Client Responsibilities
The Client is responsible for maintaining active licenses for any premium plugins, themes, or third-party software used on the website unless otherwise agreed in writing.
7. No Guarantee
Shameless Promotion makes no guarantee that software updates will prevent all security vulnerabilities, compatibility issues, downtime, or website failures.
8. Limitation of Liability
Shameless Promotion’s total liability related to this service shall not exceed the amount paid for the Website Software Updates Add-On during the applicable service term.
9. Cancellation
The Website Software Updates Add-On is billed annually and is non-refundable once service has begun. Cancellation will prevent renewal but does not entitle the Client to a prorated refund.
